I just got hurt at work — what should I do right now?
First, get medical attention. Tell your doctor exactly how the injury happened at work. Then report the injury to your employer in writing — even a text or email counts. Take photos if possible. Keep copies of everything. Don't sign anything from your employer until you've had time to read it properly. If you're unsure about anything, call us for free advice.
My employer says I don't need to make a claim — is that true?
No. Your employer cannot decide whether you make a WorkCover claim — that's your right. Some employers discourage claims because it affects their insurance premiums. If you've been injured at work, you are legally entitled to lodge a claim regardless of what your employer says.
I was partly at fault for my injury — can I still claim?
Yes. WorkCover is a "no-fault" scheme, meaning you can claim regardless of who caused the injury. Even for common law damages claims, partial fault doesn't necessarily prevent you from receiving compensation — it may reduce the amount, but you could still be entitled to significant compensation.
What if my injury gets worse after I've gone back to work?
If your condition deteriorates, you can seek further medical treatment under your existing WorkCover claim, or lodge a new claim if appropriate. It's important to see your doctor and get updated medical evidence. Don't push through pain at work — this can worsen your injury and complicate your claim.
I'm a casual worker — am I covered?
Yes. In Queensland, casual workers, part-time workers, apprentices, and labour hire workers are all covered by WorkCover. Your employment type doesn't change your right to claim. Even some contractors may be covered depending on their working arrangement.
Can I be fired for making a WorkCover claim?
Queensland law specifically prohibits employers from terminating workers solely for making a WorkCover claim. If you believe you've been dismissed or treated unfairly because of your claim, you may have additional legal options. Contact us immediately if this happens.
